ATLANTIC VIEWS

TERMS, CONDITIONS & SHORT-TERM RENTAL AGREEMENT

Cape Town, South Africa
Effective Date: 11 Feb 2024

1. PARTIES

This Agreement is entered into between Atlantic Views (Sole Proprietorship operating in Cape Town, South Africa) ("Accommodation Provider") and the Guest identified in the booking confirmation ("Guest"). By confirming a booking, making payment, or checking in, the Guest agrees to be bound by this Agreement.

2. BUSINESS STATUS

Atlantic Views operates as a sole proprietorship. Properties offered may be owned by Atlantic Views or sublet/managed on behalf of third-party property owners. All bookings are contracted with Atlantic Views as the accommodation provider. Guests agree not to institute legal action against individual property owners, body corporates, or building management.

3. BOOKING CONFIRMATION

A booking is only confirmed when required payment has been received and written confirmation has been issued. Atlantic Views reserves the right to decline or cancel bookings at its discretion, subject to applicable law.

4. PAYMENT TERMS

The Guest agrees to pay all amounts as agreed at booking. Failure to make payment may result in cancellation without refund.

5. CANCELLATION POLICY

Unless otherwise agreed in writing: 30+ days before check-in: 50% refund. Less than 30 days before check-in: No refund. No-shows: No refund. Early departures: No refund. Refunds are subject to the Consumer Protection Act where applicable.

6. OCCUPANCY & CONDUCT

The Guest agrees not to exceed the maximum occupancy, no parties or events without written approval, to comply with house rules and body corporate regulations, and to supervise children at all times. Violation may result in immediate termination without refund.

7. ASSUMPTION OF RISK

The Guest acknowledges that short-term accommodation involves inherent risks. Use of balconies, pools, stairs, elevators, gas appliances, electrical systems, inverters, generators, and proximity to the ocean is at the Guest’s own risk. The Guest voluntarily assumes all risks associated with the stay.

8. INDEMNITY

To the maximum extent permitted by South African law, the Guest indemnifies and holds harmless Atlantic Views from any claims, damages, losses, injuries, death, liabilities, or expenses arising from use of the property, pool or balcony access, load shedding or power interruptions, water supply interruptions, theft or loss of personal property, acts of third parties, weather events, or building maintenance outside our control. This indemnity does not exclude liability for gross negligence where legally prohibited.

9. LIMITATION OF LIABILITY

Atlantic Views’ total liability shall not exceed the total rental amount paid. Atlantic Views shall not be liable for indirect or consequential damages, travel disruption costs, loss of income, emotional distress, or business interruption.

10. FORCE MAJEURE

Atlantic Views shall not be liable for failure or delay caused by events beyond reasonable control, including load shedding, national grid failure, water restrictions, government action, natural disasters, civil unrest, pandemics, war, acts of God, or building-wide structural or maintenance failures. Alternative accommodation may be offered at our discretion. Refunds are not guaranteed unless required by law.

11. DAMAGE & SECURITY DEPOSIT

The Guest is liable for damage beyond normal wear, missing items, excessive cleaning, fines imposed by building management, and breach of house rules. Atlantic Views may deduct from the security deposit or pursue legal recovery.

12. PERSONAL PROPERTY

Guests are responsible for securing personal belongings. Atlantic Views is not liable for theft, damage, or loss of guest property. Guests are strongly advised to obtain travel and personal insurance.

13. TERMINATION

Atlantic Views reserves the right to terminate occupancy immediately without refund if house rules are violated, illegal activity occurs, or excessive disturbance is caused.

14. GOVERNING LAW & JURISDICTION

This Agreement is governed by the laws of South Africa. All disputes shall be resolved in the courts of Cape Town, Western Cape.

15. SEVERABILITY

If any clause is found unenforceable, the remaining provisions remain in effect.

16. ACCEPTANCE

By confirming a booking, making payment, or checking in, the Guest confirms acceptance of this Agreement.
